Mayor Letica noted that the next order of business was to have a public hearing to discuss the proposed Local Law 1-2013 authorizing a property tax levy in excess of the limit established in General Municipal Law}3-c

 

Proof of publication for the Public Hearing was read by Village Clerk, Nancy Rittenhouse.

 

The public hearing was opened:

A resident inquired if this is needed for the proposed new building.  Mayor Letica noted that the local law allows the village to exceed the tax cap for any unexpected expenditure that could arise from now until April.

A resident inquired about the Morgan Estate and funding for the sand allocation and noted if the   village is considering these for the tax cap. Mayor Letica noted that all the items you noted the village is considering and thinking about within the budget process.  This local law gives us the contingency if we need it when we adopt the budget.

A resident asked that during the public hearing will the tentative budget be discussed in detail. Mayor Letica indicated yes.

Mayor Letica made a motion to adopt Local Law 1-2013 authorizing a property tax levy in excess of the limit established in General Municipal Law }3-c, seconded by Deputy Mayor Pierce.

A local law authorizing a property tax levy in excess of the limit established in General Municipal Law § 3-c

Section 1. Legislative Intent

It is the intent of this local law to allow the Village of Asharoken to adopt a budget for the fiscal year commencing 6/01/2013 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c.

 

Section 2. Authority

This local law is adopted pursuant to subdivision 5 of General Municipal law § 3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body.

 

Section 3. Tax Levy Limit Override

Board of Trustees of the Village of Asharoken, County of Suffolk, is hereby authorized to adopt a budget for the fiscal year commencing 6/01/2013 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law  § 3-c.

 

Section 4. Severability

If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

 

Section 5. Effective date

This local law shall take effect immediately upon filing with the Secretary of State.

Mayor Letica called on Meg Cleary, who is a member of the Building Fundraising Committee.

She spoke on the progress of the Building Fundraising Committee.  She noted that this past month’s donations totaled $52,020.00 and a pledge of $500.00.  She noted that a second mailing will be going out asking for donations and assistance.  Meg Cleary read a letter from Laurie Kefalidis a resident of the village, thanking the Village for all their services and work especially during Hurricane Sandy.  She noted that a donation was sent in by The Kefalidis Family for $10,000. She has previously donated $10,000.00 during the first round of donations.  The Board thanked Meg Cleary for all her work.

 

Mayor Letica noted that we presently we have a total of $355,600.00 of donations to put towards to the building project.  We have had two residents, who have donated $25,000, one resident donated $20,000, two residents donated $7,500, six residents donated $10,000, three residents donated $5,000 and a total of forty five residents donated $1,000.  The support that this community is showing is phenomenal.  We also have a resident that has offered to supply the boilers for the buildings.  In all we have approximately 150 families who have contributed towards the building of a new Village Hall.

 

Mayor’s Report:

 

Mayor Letica reports, “As I closed my report last month I said that I hoped to be able to present some tangible results at tonight’s meeting and I am very pleased that indeed I do.

The Hurricane Sandy supplemental funding bill passed the United States Senate.  Contained within is over $30,000,000 of federal funding to complete the stalled feasibility study and begin replenishing the beach via offshore dredging.  Along with Deputy Mayor Pierce and my wife, Linda, I attended Senator Schumer’s press conference in Point Lookout on Sunday, January 27th and was able to publically thank Senator Schumer for the extraordinary effort his office put in to secure the needed funds.  The same afternoon, at the Northport Chamber of Commerce annual party, I was able to encourage State Senator Marcellino, Assemblyman Raia and Scott Martella, from Governor Cuomo’s office to do all that they can to motivate the DEC of completing the feasibility study as quickly as possible.  There is nothing new to report on the study as of today. Today I spoke to Jodi McDonald, Chief Regulatory Branch, and USACOE NY District.  She reported by email that “the next three-year cycle for nourishment of the Asharoken beach is due by 31st December 2013 and should include placement of 45,000 CY of material.”

Roadway: Mayor Letica reported that the construction project to repair the undermining of Asharoken Avenue has been completed and the ditch along the shoulder has been backfilled. He thanked the team of Andy Mendelsohn and Highway Commissioner Tony Wenderoth for a great job of engineering and supervising the actual work. At the same time substantial progress has been made on replacing the sheet wall caps and the stairs to the beach.  Completion of this project is expected this week.

PBA Contracts: Mayor Letica noted that he and Deputy Mayor Pierce had two meetings with the PBA to discuss the police contract.  The groundwork for an agreement which provides fair salary increases for our officers and long term savings for the village has been set and I hope that an agreement will be finalized very soon.

Assessor: Mayor Letica reports, “The village has ended its search for an Assessor and this evening I am very please to nominate Roger Ramme to serve in this important position.  Roger is an attorney and his credentials for this position are very impressive, serving or having served as: Special Counsel to the Town of East Hampton Board of Assessors, Special Counsel to the Town of Huntington Assessor, Special Counsel to the Village of Huntington Bay and presently as Northport Village Assessor.  He is a member of the NYS and Suffolk County Assessors Association.  Roger will also serve as Special Counsel to the village in SCAR proceedings.  I doubt that we could have found a more competent candidate.  I would like to thank Village Clerk the serving as the interim Assessor at no cost to the village.”

Budget: Mayor Letica reports, “During the month substantial time has been spent working on the fiscal 2013-14 budget.  The process began at a special meeting on January 22nd and will be finalized by the end of March.  The detailed proposed budget, when completed, will be available for review on the village website.  Your trustees, commissioners and myself are doing all that is possible to minimize any needed tax increase and we look forward to your comments and suggestions at next month’s public hearing. On January 22nd Trustee Burke, Tony Burke and I met with the First National Bank of Long Island to discuss financing options for the new village hall. We have given the bank all of the documents that they requested and the village is awaiting a response.  On January 23rd Village Hall Building Committee met and the final design is taking shape.  The committee is doing a great job of creating an affordable and functional building. On January 29th I attended a meeting hosted by Emergency Management Commissioner Bill Raisch to recap the response to Sandy.  At the meeting were Deputy Mayor Pierce, Police Commissioner/Trustee Ettinger, Trustee Burke and representatives of the Northport Police and Fire Department as well as member of Eaton’s Neck Fire Department.  Although things went rather well during Sandy this meeting allowed everyone to reflect on the areas where improvement could be made.  Interagency communication and a good understanding of our elderly and sick residents were areas which will be focused on. Finally, I had the pleasure to meet with Gary and Christine Trager who showed me the erosion that is taking place in front of their home and several of their neighbors on the bay side.  This is an issue which needs looking into.  I also met with the Kew Court residents who are continuing to look for a means to mitigate flooding of the Cul d’sac.”

 

Trustee Reports:

Deputy Mayor Pierce reported that the most important was the passage of the Hurricane Sandy relief aid and the inclusion of Asharoken as a named recipient in the amount of $30 million dollars.  She noted that additional work has to get done to complete the Feasibility Study.  But the most important part was securing the funds.  She thanked Mayor Letica for his determined and successful work on behalf of the village since Hurricane Sandy and especially this month.  Deputy Mayor Pierce reported that she attended Suffolk County Operations Emergency Meetings which have provided guidance and new information for all the municipalities to get back to pre-storm conditions.  FEMA and NYS specialists participate as well.  The meetings have now moved on to the longer term recovery projects which include infrastructure projects like Village Hall. She thanked the residents who were involved in the Shoulder Repair Project on the bay side.  Deputy Mayor Pierce attended the PBA meetings, Board meetings, a resident meeting on Kew Court, Emergency Planning Meeting, and has continued to write to elected officials for the relief aid.  She also reviewed the vouchers this month.

 

Trustee Ettinger reported that officer- in- charge Ray Mahdesian informed him of a tree that came down and fell across Asharoken Avenue near house number 540.  Officer-in-Charge Mahdesian was in constant contact with the officers, and called in an extra officer in order to control traffic due to the road closing.  Trustee Ettinger noted that he joined the police at 6:30 a.m. and LIPA arrived by 8:00a.m. and the road was then re-opened at around 9:00.am.  He noted that it was another busy month.  He worked on several items needed to complete the police and village clerk trailers.  He noted that they installed two new video cameras and a monitor in the police trailer and he managed the installation of the security & fire system as well.  He reported that he reviewed the police budget with Officer Mahdesian for the fiscal year 5/31/2014. Reviewed the village hall plans at John Ross’s office along with the other members of the Village Hall Expansion committee and attended the Special Meeting on January 22nd.  He attended the court session on January 16th. He attended the Emergency Management Lessons Learn Session on January 25th which was organized by Bill Raisch and reviewed the vouchers for the month of January.

 

Trustee Burke reported that she attended the Special Meeting held on the January 22nd.  She noted that the board reviewed the entire budget and went through it line by line to review all items.  She attended the post Sandy Hurricane Emergency Management Lessons Learn Session on January 25th.  She attended a meeting along with Mayor Letica and Anthony Burke an ex-banker to discuss potential borrowing options with a municipal bond specialist at the First National Bank of Long Island. She participated in the long term recovery conference call with Deputy Mayor Pierce.  She reviewed the vouchers for the month of January as well as the newsletter for newsletter editor, Joan Hauser. 

 

Trustee Catanzano reported that he attended the Special Meeting on January 22nd to discuss the initial run through of the budget.

 

Village Attorney:  Village Attorney Bruce Migatz noted that there is nothing new to report this month.

 

Treasurer:

Emily Hayes reported that the total amount of vouchers for the month of January was $39,755.23 and related budget transfers.

 

 Officer-in Charge

Officer-in-Charge Ray Mahdesian reported that on January 31, 2013, high winds toppled a large tree which fell across Asharoken Avenue necessitating a road closure at approximately 4 a.m.  Police notified a tree crew to remove the tree, but the crew had to wait for LIPA to respond and shut off the power.  The road was subsequently opened at 9 a.m.  There has been an increase in motor vehicle contact with deer recently.  On January 25, 2013 a car was significantly damaged after striking a deer just south of the police station.  The deer ran off after the collision. The security system for the old village hall has been extended to provide coverage for both trailers.  There were no reported burglaries in the village for the month of January.

 

 

Sanitation: Barry Bradley noted that the total trash pick-up for the month was 28.49 tons, co-mingle were 3.55 tons and newspaper and cardboard was 3.24 tons.  Totaling 35.28 tons overall. Big Blue is running well.

 

Emergency Manager: Bill Raisch thanked everyone who attended the Emergency Management Lessons Learned Session.  He noted that the meeting was held on Friday at 5:00 p.m.  Both members of the ENFD and Northport FD attended, as well as Mayor Letica, Deputy Mayor Pierce, Trustee Ettinger, Trustee Burke, Village Clerk Nancy Rittenhouse, Officer-in-Charge Ray Mahdesian, and Northport Police Chief Bruckenthal, a diversity of folks.  He noted that discussions took place going through several items such as, relationships with other municipalities to get the proper equipment, increase communications with LIPA, preparing for a water pump to handle the volume of water south of Village Hall, an increase in communication within the village as well as with other agencies, continuing to utilize the CodeRED system with the Town of Huntington as well as sharing information with the POENB and utilizing their ROBO call system.  He noted that the group recommended creating a volunteer base and untimely match volunteers with people in need on a local level.  He noted that evacuation was discussed and identifying the need for a greater advanced notice of emergency shelters near our village.  He also noted the importance of updating the list of our elderly neighbors and individuals needing assistance.

 

Superintendent of Buildings Report: Doug Adil, building inspector noted that he has been conducting walk-through of village hall with two contractors providing cost estimates to repair the structure, for use in validating the description of the structure as “Substantially Damaged”.  He met with the Village Hall Expansion Committee to review floor plan options and progress.  He met a homeowner regarding a new generator.  He has performed 16 inspections for the month of January.

 

Zoning Board of Appeals: Chairman, Russell Mathews noted that he received an email from village clerk regarding a ZBA application and will refer to counsel.

 

Village Hall Expansion Report:  Chairman, John Ross reported that applications have been submitted to the NYSDEC.  He noted that the working floor plan has been finalized and in the process of getting preliminary bids this month.

 

Conservation Board: Marty Cohen Chairman of the Conservation Board noted that the Suffolk County Department of Transportation has forwarded our DDIR to FHWA. We have requested that they expedite the approval process.  He noted that we are hoping to hear back from them via email and then to follow up in writing.  We hope to begin the dune project soon. 

 

Mayor Letica added one additional point to his report; he noted that he spoke with Mayor Doll and requested an updated contract for our fire & EMS service for next year.

NOW, THEREFORE, BE IT RESOLVED that this Board has examined said account, and compared it with the original tax rolls, and hereby certifies it to be correct.

WHEREAS, the Village Clerk by the 1st day of February, 2013 did return and file an account of unpaid taxes to this board for the year 2012 & 2013, and

WHEREAS, the Board of Trustees met at the American Legion Hall in Northport on the 22nd day of January 2013 and did examine such account and did compare it with the original tax rolls and did therefore, certify to the effect that they found it be correct,

NOW, THEREFORE, this Board, pursuant to Article 14 of the Real Property Tax Law of the State of New York, determines to collect the amount of such unpaid taxes levied or assessed for the year 2012 & 2013 by a tax lien sale in accordance with procedures authorized by the Board of Trustees in the manner and after the form and resolution, certified by the Clerk, shall be transmitted forthwith to the Treasurer of the Village with the account, affidavit, and certificate of such unpaid taxes and is authorized and directed to cause to be published in the official paper of the Village, once each week for three consecutive weeks, a list as shown in the tax roll, with the amount of the tax, penalties, and charges thereon, excepting there from such parcels of property on which the Village holds and owns one or more unredeemed certificates of tax sale; and also a notice  that the said real estate will, on a day subsequent to the expiration of said three weeks to be determined by said Village Clerk and specified in said notice, be sold at a place in said Village to be designated by said Village Clerk, to discharge the tax, penalties, and charges aforesaid, which may be due thereon at the time of such sale, and that the said Village Clerk, at the time and place specified in said notice, proceed with the sale of said real estate upon which such taxes are unpaid, as set forth above, and continue the same from day to day until the sale is completed.  That such real estate shall be sold subject to any unpaid assessments thereon levied by the Village of Asharoken and also subject to any unpaid tax liens purchased and held by the Village.

 

AND BE IT FURTHER RESOLVED, that in all cases where no bid shall be made on a lot or parcel of land so offered for sale for an amount sufficient to pay the said tax, penalties, and charges, the said premises shall be deemed to have been sold to and purchased by the Village of Asharoken, New York

The Village Clerk has advised that the tax sale referred to in the foregoing resolution would be held on Tuesday, March 12, 2013, at 1pm, at the Village Hall trailer, 1 Asharoken Avenue, Northport, New York, and that publication of the list of properties to be sold would commence on or about February 22, 2013, and be it further resolved that the Village Board reserves its right to authorize and direct the Village Treasurer on behalf of the Village to reject any and all bids for parcels of lands listed in the annual tax lien sale to be held as set forth herein and, and to bid in and purchase if necessary the same for the Village.

AND BE IT FURTHER RESOLVED, that the Village Board reserves the right to withhold any and all said tax liens from sale and/or to cancel said tax lien sale.

Deputy Mayor Pierce made a motion to waive the reading.

Public Session:

A resident asked about a solution to protect the roadway using the oversized sandbags “sausages”.

A resident asked about the feasibility study and which side of Asharoken Avenue the study is being done on.  Mayor Letica noted that the feasibility study is primarily for the sound side.

A resident asked about the feasibility study and what the next steps are and the time frame as to when it will be finished.  Mayor Letica noted that he spoke with Gene Brickman and Gene noted that a meeting took place on January 22nd and it was a productive meeting.  He noted that he has encouraged our state Senators and Governor to push along the DEC.  

A resident asked about the rocks from the seawall and asked if they will be put back. Mayor Letica indicated that the rocks will be put back.

A resident asked about the placement of sand from LIPA.

A resident asked about where the placement of sand from LIPA will be.  Mayor Letica noted that the village does have some say as to where the placement of sand will go.

A reporter asked about how much sand we will be getting, and how much we need and how long it will cover the village and for how long it will last.

A resident asked what the status was of the Article 78.  Village Attorney, Bruce Migatz noted that they have not put that on the calendar and he had not heard from the attorney who represents the home owner.
