Mayor Irving called the meeting to order.

Proof of Publication was noted.

 

Approval of the Regular Board Meeting minutes for 3/5/2012, Mayor Irving made a motion to accept the minutes, seconded by Trustee Catanzano.

Mayor Irving introduced Senator Carl Marcellino

 

Mayor’s Report:

Sand on the Beach: Mayor Irving reported that this past week she had a three hour meeting with NYSDEC staff Al Fuchs and Sue McCormack.  She noted that the DEC no longer has the position of “no” dredging in Long Island Sound.  The DEC has agreed to work with the Army Corps in completing the feasibility study which likely would recommend Long Island Sound as the source for the needed sand.  Mayor Irving noted that the project still has a long way to go, but it is back on track and I expect one day we will see the restoration of Asharoken beach. Mayor Irving noted that Senator Carl Marcellino was instrumental in getting the attention of Commissioner Joe Martens. Senator Carl Marcellino was invited to attend the Asharoken’s Board Meeting by Mayor Irving to discuss “Sand on the Beach”.  Mayor Irving introduced Senator Carl Marcellino.  The Senator noted that Mayor Irving is the person to thank for being so persistent every step of the way.  She is the one who has been making every effort to communicate Asharoken’s concerns about the seawall and lack of sand. Senator Marcellino noted that he received a video which was taken by Trustee Pierce.  Mayor Irving had passed along the video to Senator Marcellino who shared it with Commissioner Martens of the DEC.  The Senator noted that he had a conversation with the Commissioner after viewing the video and expressing his concerns that if the road becomes breached you are isolating a whole segment of families that live beyond the seawall.  He communicated to the Commissioner that there are families and homes that need to be taken into consideration.  Per the Senator, Commissioner Martens said that he would weigh it all and the results have been positive from the DEC.  The Senator again thanked Mayor Irving and noted that she deserves the majority of credit for the success of our joint efforts. 

 

Sea wall Repair: Mayor Irving reported on the sea wall repairs.  The Asharoken Seawall was rebuilt by the Army Corps of Engineers in 2010.  Unfortunately, many of those repairs were destroyed by tropical storm Irene in 2011.  Although the repairs were less than a year old, the Army Corps disclaimed responsibility.  Mayor Irving noted that the village argued that the caps were a design defect and the work should have been covered under a warrantee.  The Army Corps position was that the wall was rebuilt to its original condition and that the Corps could do no more.  Mayor Irving noted that this was unacceptable and she put the pressure on .  This past week she learned from Congressman Israel’s office that funding has come through to design a fix for the sea wall.  The Army Corps is currently working on a re-design cap.

 

Mayor Irving noted that she prepared an update on the “Sand on the Beach” and the “Seawall Repair” information and sent out a mailing to all residents informing them of the new updates.

 

SPDES Permit for the Village of Asharoken: Mayor Irving noted that she received a formal letter this past month from the US Environmental Protection Agency (EPA) notifying the Village that they have completed the Village’s MS4 audit and issued a final report for the Village of Asharoken as complete and satisfied.

 

Emergency Management: Mayor Irving noted that the Village’s “Comprehensive Emergency Management Plan” has been completed.  The Board has reviewed the latest changes and a resolution to adopt the plan is on the agenda.

 

Budget: Mayor Irving reported that the Village has received 100% of village taxes and arrears from all property owners.  She also noted that she received a hand written note from a resident thanking her for the budget.

 

Newsletter: Mayor Irving thanked many residents who have responded to help save our Village more money on future printing and mailing costs by receiving Village material via emails. Correspondence: Mayor Irving received updated information from the homeowners on Carter’s Bight. She received a certified mailed package from resident Avrum Golub on Friday March 30th and an email later Friday evening. She noted that with such short notice, this will need to be reviewed for next month’s meeting.

 

Trustee Reports:

Deputy Mayor Tilleli thanked Senator Marcellino for working with Mayor Irving for opening the lines of communication with the NYSDEC.  He reported that he had the village landscaper Patrick Parker remove a tree near the Avenue.  He organized the re-planting of beach grass near the north end of the seawall.  The cost of the beach grass, and the labor involved have been reimbursed by FEMA from Tropical storm Irene.  He also reported that he received three approved bidders from Suffolk County Public Works department for striping which will be discussed next month.

 

Trustee Pierce reported that she attended three of the court sessions for the month of March.  She noted that she attended the ZBA hearing held on March 20th.  She noted that she participated in the meeting with Al Fuchs and Sue McCormack from the NYSDEC.  She noted that she met with two residents during the month of March on various issues.  She also thanked Senator Marcellino for all his help and assistance.

 

Trustee Catanzano reported that on March 14th he attended the court session and on March 20th he attended the ZBA hearing.  He noted that he approved the vouchers for this month and assisted in the village mailing.  He thanked Senator Marcellino for all his efforts.

 

Village Attorney:  Ken Savin reported that the seawall stabilization is complete.  He noted that the snow fence has been removed.   He reported that he attended the ZBA hearing on March 20th, one matter was being continued.  The next ZBA meeting will be held on May 8th.  He reviewed an old ZBA decision and received a letter from Planning Board Chairman, Patrick Cleary about sub-dividing a sixty foot beach lot.  He attended the NYSDEC meeting with Trustee Pierce and Mayor Irving and reviewed several code issues.  He reviewed many FOIL requests and had a conversation with Robert Freeman, Chairman for NYS committee on Open Government who provided information on how to respond to these FOIL’s.  He noted that he reviewed and approved the Fireworks contract.  He noted that cablevision’s international channels were moved and cablevision packages are increasing in cost.  He noted nothing new on litigation this past month.

Treasurers Report: Vouchers for the month of March 2012:  Treasurer, Emily Hayes requested approval for vouchers in the amount of $33,599.12 and related budget transfers.

Officer-in-Charge:  Ray Mahdesian reported that we had a safe month.  He reported that Officer O’Connor attended the one-day personal Radiation Detector Course given at the Suffolk County Academy on March 5th.  No reported burglaries in the village for the month of March.  He reported that the Village Police department assisted Northport Police department on a drug bust several weeks ago.  He also noted that the department assisted a few residents.

 

Sanitation Report: Barry Bradley reported that Big Blue was running well.  Trash pick-up was 21.90 tons, comingle was 1.87 tons and newspaper and cardboard was 3.59 tons. 

 

Superintendent of Buildings Report: Doug Adil reported that he addressed several inquires on guidelines for installation of pools.  He performed several inspections on ongoing projects and inspected several footings and foundations that are underway.

 

Village Clerk, Nancy Rittenhouse noted that the next ZBA Meeting will be held on May 8th for two carryover applications.

 

Mayor Irving opened the meeting for public session.

 

A resident thanked Senator Carl Marcellino for coming.

A resident shared information about one of the resident’s Kathy Martin, whose name was on the cover of the New York Times sports section, she noted that the article referred to her accomplishments as an athlete.

Thury as an alternate at an hourly wage of $9.50.

Resolution (2012-21) Be It Resolved, that the Village Board of the Village of Asharoken, NY in regular session duly convened, does hereby appoint Village Treasurer, Emily Hayes and Village Clerk, Nancy Rittenhouse to collect taxes that may be due for the fiscal year 2012-2013, between the hours of 9:00am and 3:00pm except Saturday and Sundays and Legal Holidays.

Resolution (2012-22) Be It Resolved, that the Village Board of the Village of Asharoken, NY in regular session duly convened, does hereby authorize, that pursuant to Section 1428 of the Real Property Tax Law the Warrant and Tax Roll for Collection of Village taxes of the Incorporated Village of Asharoken has been filed with the Village Treasurer for the fiscal year beginning June 1, 2012  Taxes will be received at the Village Hall, One Asharoken Avenue, Asharoken, from June 1, 2012 daily from 9am to 3pm except Saturdays and Sundays and Legal Holidays until and including July 2nd 2012 without fee.  Five percent will be added to taxes received after July 2, 2012 and one percent for each month thereafter until paid in full.

Resolution (2012-23) Be It Resolved, that the Village Board of the Village of Asharoken, NY in regular session duly convened, does hereby adopt the financial reporting requirements of GASB Statement 54,

 

WHEREAS, the Governmental Accounting Standards Board (GASB) issued in 2009, a statement to enhance the usefulness of fund balance information known as GASB Statement 54; and

WHEREAS, that statement establishes accounting and financial reporting for governmental fund balances for all governments, including Villages; and

WHEREAS, the Village is required under Article 3 of the General Municipal Law to file an annual financial report with the Office of the New York State Comptroller, said reporting requirement being accomplished by the filing of the Annual Update Document (AUD); and

WHEREAS, the Office of the State Comptroller (OSC) adopted a memorandum dated April 2011 concerning fund balance reporting, governmental fund type definitions, and notes to financial statement disclosures required under GASB Statement 54; and

WHEREAS, the Village is desirous of complying with financial reporting requirements of GASB 54; and

NOW, THEREFORE, BE IT RESOLVED, that the Village will implement the reporting requirement of GASB 54; and

BE IT FURTHER RESOLVED, that the Treasurer prepare the Village's AUD in accordance with the fund balance reporting requirements mandated under GASB 54 and established by the Office of the State Comptroller; and

BE IT FURTHER RESOLVED, that the Treasurer will adopt the fund balance classifications and definitions as provided for in the OSC memo appended hereto; and

BE IT FURTHER RESOLVED, that the authority to assign fund balances lies with the Board of Trustees; and

BE IT FURTHER RESOLVED, that the Village shall make the required disclosures and explanations of their fund balance classifications in the notes to their financial statement and establish the order of spending of fund balances, and

BE IT FURTHER RESOLVED that in adopting this policy the Board of Trustees are committed to ensuring that the Village maintains adequate reserves to guarantee the rendition of necessary emergency services by the Village in the event of adverse economic conditions, revenue shortfalls and unforeseen expenditures due to emergency conditions; and

BE IT FURTHER RESOLVED, that the reporting requirements under this resolution shall be effective with the beginning of the year ending 5/31/2012.  On roll call, the foregoing resolution was duly put to a vote and the vote was follows:
