Mayor’s Report;” During the month the Village worked with the NYSDEC to amend its letter dated November 29,2018 asking the USACOE to create a Locally Preferred Plan for the seawall area.  This amendment was needed in order to better conform to the USACOE’s expectations for a letter requesting a study to create a LLP.  The amended letter is very similar to the original but instead of asking the Corps to study various aspects of the plan it advised the Corps of the Villages desire to have an improved beach, new seawall and an elevated road in the seawall area.  The amended letter has been shared with the Town of Huntington and, pending Board of Trustee approval, will be sent to the DEC tomorrow.

 

I met with Andrew Walker of the NYSDEC last Tuesday to review the plan to take sand that has washed into the Bevin Road wetlands and transfer it in an effort to augment a section of the dune in the beach lot area.  The Village was seeking guidance to get a NYSDEC permit for this project as quickly as possible.  The Village is waiting to hear back and should have an answer in the next few weeks.

 

I had a phone call with State Senator Jim Gaughran last Friday. Senator Gaughran is looking into grant money for the Village to assist in the dune repair as well as improvements to the shoulder of Asharoken Avenue opposite the Bevin Road Seawall.  Additionally, Senator Gaughran is working to set up a meeting with Senator Schumer, Congressman Suozzi and other local elected officials to strategize on how to move forward with the seawall area restoration.  This meeting hopefully will take place prior to the next Board of Trustees meeting.

 

Lastly, I attended the annual Northport Chamber of Commerce luncheon last Sunday.  This is a really nice event that gave me an opportunity to discuss Asharokens’s pressing issues and needs with many of our local elected officials.

 

Trustees:

Deputy Mayor Pierce reported that she reviewed the minutes and vouchers, participated in one shared service teleconference this month.

 

Trustee Ettinger reported that he spent time with Officer- in-Charge Mahdesian with the final submittal of the 2019-2020 police and court budget. He reported that he worked on solutions to make the roadway near the seawall safer; by having new street signs ordered to be installed on both sides of the roadway to aide motorists. He also reported that the village received three engineering proposals for studies for a guiderail in the seawall area and spoke with PSEG for possible street lights in the area as well.  He reviewed the minutes and the vouchers.

 

Trustee Jablonski reported that he reviewed the minutes and vouchers for the month.

 

Village Attorney: Attorney Migatz reported that neither the Zoning Board nor the Planning Board held a meeting in the month of January. He noted that we do not have a decision from the court on the challenge to the denial of the dock permits, it is still pending.

 

Village Treasurer: Emily Hayes Treasurer reported that the vouchers for the month of January were $26,609.11 and noted that there was nothing unusual to report. There will be a separate resolution to approve the vouchers and budget transfers.

 

Sanitation Operator: Barry Bradley reported that big blue is running well. Total tipping fees for the month of January were $1614.40. Trash tonnage 20.18, paper & cardboard 1.67 tons; glass 1.37 tons, plastic and metal .77 tons.

 

Building Inspector: Doug Adil reported that he discussed road stabilization measures with a homeowner at 501 Asharoken Avenue to help stabilize his driveway. He reviewed drawings from 413 Asharoken Ave. He performed 7 inspections.

 

Conservation Board Chairman:  Marty Cohen had nothing to report this month.

 

Police Report: Trustee Ettinger gave the report for officer Mahdesian; he reported that 39 summonses were issued, 2 arrests were made and the Village received a Justice Court grant in the amount of $2,027.00. Also on January 30th a large tree toppled over in the area of 561 Asharoken Avenue causing the road to be closed for approximately 2.5 hours.

 

Resolution (2019-09) Be It Resolved, that the Village Board approves the budget transfers for the month of January 2019.

Resolution (2019-10) Be It Resolved, that the Village Board does hereby approve the vouchers for the month of January 2019 in the amount of $25,609.11.

Resolution (2019-11) Be It Resolved that the Village Board does hereby appoint a committee of the Board of Trustees to include, Mayor Letica, Deputy Mayor Pierce, Trustee Ettinger, Trustee Burke and Assessor Paul Wotzak  as the Board of Assessment Review for the purpose of reviewing any complaints regarding the 2019/2020 assessments filed on or before Grievance Day, February 19th, 2019 and to be reviewed during the hours from 1:30am to 5:30pm at Village Hall, One Asharoken Avenue, Northport, NY 11768.

Resolution (2019-12) Be It Resolved, that the Village Board does hereby authorize the Mayor to sign the amended commitment letter dated January 31, 2019 from the Village of Asharoken and the Town of Huntington to have the US Army Corps of Engineers (USACE) develop the Locally Preferred Plan (LPP) for the construction of a project to protect a critical section of Asharoken Avenue/Eaton’s Neck Road at the seawall location, attorney Migatz approved as to form.

NOW, THEREFORE, this Board, pursuant to Article 14 of the Real Property Tax Law of the State of New York, determines to collect the amount of such unpaid taxes levied or assessed for the year 2018/2019 by a tax lien sale in accordance with procedures authorized by the Board of Trustees in the manner and after the form and resolution, certified by the Clerk, shall be transmitted forthwith to the Treasurer of the Village with the account, affidavit, and certificate of such unpaid taxes and is authorized and directed to cause to be published in the official paper of the Village, once each week for three consecutive weeks, a list as shown in the tax roll, with the amount of the tax, penalties, and charges thereon, excepting there from such parcels of property on which the Village holds and owns one or more unredeemed certificates of tax sale; and also a notice  that the said real estate will, on a day subsequent to the expiration of said three weeks to be determined by said Village Clerk and specified in said notice, be sold at a place in said Village to be designated by said Village Clerk, to discharge the tax, penalties, and charges aforesaid, which may be due thereon at the time of such sale, and that the said Village Clerk, at the time and place specified in said notice, proceed with the sale of said real estate upon which such taxes are unpaid, as set forth above, and continue the same from day to day until the sale is completed.  That such real estate shall be sold subject to any unpaid assessments thereon levied by the Village of Asharoken and also subject to any unpaid tax liens purchased and held by the Village.

 

AND BE IT FURTHER RESOLVED, that in all cases where no bid shall be made on a lot or parcel of land so offered for sale for an amount sufficient to pay the said tax, penalties, and charges, the said premises shall be deemed to have been sold to and purchased by the Village of Asharoken, New York

The Village Clerk has advised that the tax sale referred to in the foregoing resolution would be held on Tuesday, March 12, 2019, at 10am to 12 noon, at the Village Hall, 1 Asharoken Avenue, Northport, New York, and that publication of the list of properties to be sold would commence on or about February 14, 2019, and be it further resolved that the Village Board reserves its right to authorize and direct the Village Treasurer on behalf of the Village to reject any and all bids for parcels of lands listed in the annual tax lien sale to be held as set forth herein and, and to bid in and purchase if necessary the same for the Village.

AND BE IT FURTHER RESOLVED, that the Village Board reserves the right to withhold any and all said tax liens from sale and/or to cancel said tax lien sale.

Mayor Letica made a motion to summarize and read several sections of the resolution; Village Clerk Nancy Rittenhouse read the first and fifth paragraphs.

Mayor Letica opened up discussion relating to new business. Mayor Letica discussed with the board that we are working on getting an estimate for the small leak in the second floor storage area of the building. We also spoke with Newport engineering; they suggested getting a surveyor to plot out the specific area where the village would like to pull the sand from for the dune restoration.  We are waiting to hear back from the NYSDEC and then we can move forward.

 

Mayor Letica opened up the meeting for public session.

 One comment was made;

1.      A resident asked if both the original letter and the amended letter to the NYSDEC will be made on available on the website.
